Gay Couple Under Fire for Sex Offender Husband Who Used Legal Loophole to Adopt Surrogate Child

A gay couple, Logan Riley and Brandon Mitchell, are under fire for adopting a surrogate child since Mitchell is a registered child sex offender, according to Newsweek

Last weekend, Riley and Mitchell posted a video on X celebrating their surrogate child’s first birthday. The internet soon blasted the couple, outraged that Mitchell, a Tier 1 sex offender in Pennsylvania, could have full legal custody of a surrogate child in that same state. 

Mitchell’s sex offense history stems from ten years prior, when he worked as a chemistry teacher at Downingtown West High School. 

In 2016, Mitchell was arrested for attempting to solicit a 16-year-old boy for sexual abuse, ShoreNewsNetwork reported.

According to Reduxx, he had exchanged more than 12,000 text messages with the minor and demanded that the boy send him nude photographs. He also wanted to watch the victim masturbate and sent the victim approximately 20 nude pictures of himself. 

The police had also found hundreds of sexually explicit videos of the victim on Mitchell’s laptop.

Eventually, Mitchell pleaded guilty to felony child pornography possession and was sentenced to up to 23 months of incarceration. However, he was granted parole just two months after his conviction, Reduxx said.  

Years later, Mitchell and his husband, Riley, started a GoFundMe to raise money for a surrogate child. The post has been deleted since the internet’s outrage that a convicted child sex offender could have legal custody of a child in Pennsylvania. 

Unfortunately, some are trying to let Mitchell off the hook. His former attorney, Peter Kratsa, stated that Mitchell’s criminal case was 12 years ago and did not involve allegations of physical contact, according to PennLivePatriotNews

“Brandon immediately accepted responsibility for his conduct, served his sentence without incident, and engaged in extensive counseling,” Kratsa said. “[He] did nothing illegal or unethical in becoming a surrogate parent.”

Others, like the liberal media, dare not cover this issue.

But many in Pennsylvania, especially conservatives, want to take action against Mitchell. Republican Rep. Aaron Bernstine plans to introduce a bill “prohibiting sex offenders from parenting through surrogacy,” which would enforce adoption safeguards for children born through surrogacy, TMZ reported.  

“This isn’t about politics,” Bernstine said. “It’s about basic human decency and common sense. No known predator should ever be given the legal right to raise a child in Pennsylvania.” 

Republican State Senator Camera Bartolotta also announced that Pennsylvania would enforce stricter regulations on adoption and surrogacy, TMZ said.

York County District Attorney Tim Barker addressed the concerns over the legal loophole allowing a registered sex offender to become a parent through surrogacy, PennLivePatriotNews reported. He wants the legislature to review the issue and said his office would follow up with charges if a criminal allegation were brought to them. 

Not only are politicians rallying against Mitchell, but the public is taking action. A petition on change.org with 9,000 signatures is calling to remove the child from Riley and Mitchell’s custody and prohibit sex offenders from accessing surrogacy children. 

This Pennsylvania legal loophole is a serious problem that endangers children by allowing child predators to adopt them via surrogacy. Pennsylvania's got to wake up. The surrogate child is not safe — but neither is Mitchell from the long arm of the law.
