A 77-year-old man in Oakland, California, was arrested Monday night on suspicion of murder after police said he fatally shot one of three burglars who’d broken into his home.
Although he hasn’t been formally charged with anything yet, the man, whose name wasn’t released, was taken in by police after they showed up to his home and found one person dead and the homeowner pointing his gun at a female burglary suspect.
According to a witness, three people - two men and a woman - arrived at the man's home in East Oakland late Monday night in a vehicle that was later determined to have been stolen. The witness told police one of the men had a crowbar. Moments after the trio disappeared onto the property, the witness heard a gunshot and called the police.

Police arrived to find a man lying dead just inside the fence line of the property, and the elderly resident pointing a gun at the female would-be burglar. A second male suspect was also on the scene and found to be in possession of a fake gun.
It remains to be seen whether the man will be charged with murder, or whether the shooting will be deemed self-defense. The incident is now being investigated as a possible homicide. According to California law, a homeowner isn’t legally allowed to shoot a criminal if they’re fleeing, even if the person broke into a private residence.
With idiotic rules like these, it’s no wonder crime in Oakland is out of control.
