NM Sheriff Says Gov's 30-Day Gun Ban 'Unconstitutional,' 'Does Nothing to Curb Gun Violence'

It doesn’t matter how many authoritarian politicians attempt to infringe on your rights as an American, there will always be those that buck those agendas and protect the Constitution despite any repercussions that might come their way as a result.

Last Friday, New Mexico Gov. Michelle Lujan Grisham (D) instituted a “public health order” that suspended the right to publicly carry firearms in Albuquerque and the rest of Bernalillo County for 30 days.

But, Bernalillo County Sheriff John Allen said that “there’s no way we can enforce that order,” because he correctly asserted that the “order” is “unconstitutional.”

"It’s unconstitutional, so there’s no way we can enforce that order," Allen said on Monday, according to Fox News. "This ban does nothing to curb gun violence.”

Allen displayed a level of integrity rarely seen anymore when it comes to the rights of Americans.

“We must always remember not only are we protecting the Second Amendment, but at the same time, we have a lot of violence within our community,” Allen added. “Let me be clear, I hold my standards high, and I do not or never will hedge on what is right.”

Amen, sir.

Grisham enacted the suspension of gun rights because of a “recent instances of gun violence,” as Fox News reported. However, the gun didn’t do anything besides do what the criminals holding them animated them to do. A gun is only as violent as the person holding it.

Allen’s comments are a turnaround from his stance last Friday when Grisham announced the move. The sheriff stated then that while he wasn’t sure about the constitutionality of the suspension, Fox News reported that he was “prepared to cooperate to address gun violence.”

But Allen’s comments from last Friday indicated that he was more in the camp of not acquiescing to the order and seems to contradict Fox News’ assessment of his comments.

“While I understand and appreciate the urgency, the temporary ban challenges the foundation of our constitution, which I swore an oath to uphold," Allen said in a statement. "I am wary of placing my deputies in positions that could lead to civil liability conflicts, as well as the potential risks posed by prohibiting law-abiding citizens from their constitutional right to self-defense.”

Good on Allen for coming to his senses and directly saying that he will NOT cooperate with Grisham’s order.

No matter how genuine Grisham is in her push to make New Mexicans safer under her watch, it doesn’t give her license to impugn on her constituents constitutional rights.
