Despite there being a hung jury on the manslaughter charge against subway “vigilante” Daniel Penny, the charge of criminally negligent homicide still remains on the ledger for the jury to decide.

In light of all that, Rep. Eli Crane (R-Ariz.) has taken it upon himself to introduce a House Resolution to award Penny with a Congressional Gold Medal for “his heroism.”

“A BILL To award a Congressional Gold Medal to Daniel Penny, who protected women and children of the city of New York, New York, from violence on May 1, 2023,” the introduction to the HR reads.

As you can read above, Sec. 2 Findings details as follows:

The Congress finds as follows:

  1. Thoughout President Biden’s term as President, local governments across various cities and States failed to adequately protect residents and their property from violent criminals.
  2. On May 1, 2023, an individual began aggressively threatening Daniel Penny and other passengers on a New York City subway.
  3. Daniel Penny, with others, acted to save New York City subway riders from threatening behavior by restraining a criminal — who had 42 prior arrests and an active warrant — until police came.
  4. The courageous actions taken in response to the threat to his community by Daniel Penny, a decorated U.S. Marine Corps veteran, went beyond the civilian call of duty.

At the end of the day, Penny merely thought that he was helping to protect others from an increasingly aggressive and potentially violent man.

It remains to be seen if this resolution is passed and Penny awarded the medal, not only for “his heroism” as Crane wrote in a post on X, but for the ordeal of having to be prosecuted for doing what he thought was right.
